Things to keep in mind…

Limitation Periods

In almost all cases involving accident or injury, you have two years to bring a lawsuit before your claim is statute-barred.  Much stricter timelines (often mere days) apply to certain claims for accidents in public spaces such as city sidewalks—so do not delay in seeking legal advice.

Slip and Fall Accidents

All property owners have a duty to keep their premises reasonably safe.  If you have been injured due to slippery conditions, poor lighting, or other hazards, you may be entitled to compensation.  Standards and procedures vary for injuries in public places, business premises, and private residences.  We will discuss your situation with you and help you choose the best course of action.  Call us without delay.

Motor Vehicle Accidents

The statutory insurance scheme in Ontario provides basic benefits to all persons injured in a motor vehicle accident.  Those benefits are listed in the Statutory Accident Benefits Schedule (“SABS”).  We can help you with the SABS process and help you deal with the insurance company that is supposed to pay your benefits.  If necessary, we will represent you at the Financial Services Commission of Ontario to resolve disputes with the insurer over your entitlement to statutory accident benefits.

Ontario’s insurance system is designed to cover most victims’ needs during their recuperation while reducing the load on our courts.  However, in cases of catastrophic injury or serious, permanent impairment, the only effective way to compensate victims and their families for pain and suffering and to provide for future needs is a lawsuit.  Does your case meet the threshold?  We can advise you.  Please call us for a free initial consultation.

Medical Malpractice

Health care professionals are highly trained individuals, usually skilled and effective in their area of practice.  Properly, those to whom we entrust our well-being are held to a high standard of care.  When mistakes happen, the consequences can be severe.  Medical malpractice is a specialized type of litigation concerned with errors in diagnosis, treatment, protocol, or performance on the part of doctors, nurses, and hospitals.  Stevensons LLP can assess your case and help you decide whether you ought to sue.  We gather the medical evidence, locate the experts who will aid the court with their testimony, and advocate strenuously for patients’ rights in cases of medical malpracticePlease call us to discuss your situation.

Fatalities

In the tragic circumstances of a wrongful death, the law allows compensation for surviving family members for their financial losses and the loss of companionship, care, and guidance of the deceased.  In cases of wrongful death, we conduct proceedings to establish liability and obtain the compensation to which the survivors are entitled.  Please call us for a free consultation.
